PostyLab Terms of Service (Terms & Conditions)

These Terms of Service (“Terms”) govern your access to and use of the PostyLab platform, website, and related services (collectively, the “Service”). The Service helps users connect supported third-party social accounts and manage, schedule, and publish content to third-party platforms.

By creating an account, accessing, or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

1) Company Information

The Service is operated by QBIXOSFT COM (“PostyLab,” “we,” “us,” or “our”), based in Bogotá, Colombia.

2) Eligibility and Authority

You must be at least 18 years old (or the age of majority in your jurisdiction) and able to form a binding contract to use the Service. If you use the Service on behalf of a company or organization, you represent that you have authority to bind that entity, and “you” includes that entity.

3) Account Registration and Security

You are responsible for:

  • keeping your login credentials confidential,

  • restricting access to your account,

  • all activities under your account (including actions by your team members).

You must provide accurate information and promptly update it if it changes. We may suspend or terminate accounts that use false or misleading information.

4) The Service and Third-Party Platforms

PostyLab provides tools to create, store, schedule, and publish content to third-party platforms (e.g., Meta/Facebook/Instagram, TikTok, YouTube, and others as available). Third-party platforms are not controlled by PostyLab.

No guarantee of publication or timing. Publishing and scheduling depend on third-party platform APIs, permissions, rate limits, reviews, outages, and policy changes. As a result:

  • scheduled posts may publish later than intended,

  • posts may fail,

  • accounts may require reconnection,

  • platforms may restrict content or revoke permissions.

You accept that PostyLab is not responsible for third-party platform behavior, changes, or availability.

5) Social Account Connections, Permissions, and Tokens

To enable publishing, you may connect third-party accounts. By connecting, you authorize PostyLab to:

  • access only the data and permissions you grant during authorization,

  • store access tokens/keys securely as needed to provide the Service,

  • perform actions you request (such as publishing/scheduling) through the Service.

You are solely responsible for:

  • owning or having rights to manage connected accounts/pages/channels,

  • maintaining required admin roles and permissions,

  • complying with the third-party platform’s terms, policies, community guidelines, and API rules.

6) Customer Content (Your Content) and Your Responsibilities

Customer Content” includes any text, captions, images, videos, audio, links, metadata, hashtags, and other materials you upload, generate, store, schedule, or publish via the Service.

You represent and warrant that:

  • you own or have obtained all rights/licenses/permissions necessary for your Customer Content,

  • your Customer Content does not violate any laws or third-party rights (including copyright, trademark, publicity, privacy),

  • your Customer Content and usage comply with applicable third-party platform rules.

You are responsible for your Customer Content and the consequences of publishing it.

7) Prohibited Uses

You may not use the Service to:

  • violate any law or regulation;

  • infringe IP, privacy, or other rights;

  • publish or distribute illegal content (including child sexual abuse material—zero tolerance);

  • facilitate harassment, threats, or unlawful discrimination;

  • distribute malware, exploit vulnerabilities, or attempt unauthorized access;

  • scrape the Service or platforms in violation of their rules;

  • engage in spam, deceptive automation, or inauthentic engagement;

  • bypass platform limitations, or use the Service in ways that violate platform API policies;

  • use the Service for sanctioned or prohibited activities under applicable export/sanctions laws.

We may suspend/terminate access if we reasonably believe you violated these Terms or created risk for PostyLab, other users, or third parties.

8) Intellectual Property (PostyLab)

The Service, including its software, design, logos, and content (excluding Customer Content), is owned by or licensed to PostyLab and protected by applicable IP laws.

Subject to these Terms and your subscription, PostyLab grants you a limited, non-exclusive, non-transferable, revocable license to use the Service for your internal business or personal purposes.

You may not:

  • copy, modify, or create derivative works of the Service (except as permitted by law),

  • reverse engineer or attempt to extract source code (except where legally prohibited from restricting),

  • resell or sublicense the Service,

  • remove proprietary notices.

9) Feedback

If you submit suggestions or feedback, you grant PostyLab a worldwide, royalty-free, perpetual, irrevocable license to use it without compensation.

10) Subscription Plans, Billing, Renewals, and Taxes

If you purchase a paid plan:

  • fees are billed in advance (monthly/annual or as shown at checkout),

  • subscriptions may renew automatically unless canceled before the renewal date,

  • you authorize charges to your selected payment method via our payment processor.

Taxes: You are responsible for all applicable taxes, duties, or levies, unless we are legally required to collect them.

Refunds: Unless required by law or expressly stated in an official PostyLab refund policy, fees are non-refundable. If you want a stricter or more generous refund policy, publish it clearly and make it consistent with local consumer rules.

11) Free Trials and Promotions

Trials or promotional discounts may be offered at our discretion and may be changed or ended at any time. If a trial converts to paid, billing will begin as described at signup/checkout unless you cancel beforehand.

12) Service Limits and Fair Use

We may apply plan-based limits (e.g., number of connected accounts, scheduled posts, workspaces, team members, storage, API calls). We may throttle, suspend, or restrict usage that threatens system stability or violates fair use.

13) Data, Privacy, and Security

Our collection and use of personal data is described in our Privacy Policy: /pages/privacy-policy.

Your compliance obligations: You are responsible for ensuring you have appropriate legal bases/consents to process personal data through the Service, especially if you manage third-party pages or publish content involving personal data.

Colombia: If applicable, personal data processing may be subject to Colombian data protection law (including principles commonly associated with Law 1581/2012 and related regulations).
United States: Depending on your users/customers, certain state privacy laws (e.g., California) may apply.
China: If you or your end users are in China, laws such as the Personal Information Protection Law (PIPL) and cross-border transfer rules may apply.

Cross-border transfers: The Service may involve processing and storage of data in multiple countries. You consent to such processing and transfers, and you represent you have authority and legal basis to do so.

14) Copyright/IP Complaints

We respect intellectual property rights. If you believe material on the Service infringes your rights, contact us at qbixsoftsupport@gmail.com with sufficient details to identify the work and the allegedly infringing material. We may remove content or restrict access where appropriate.

15) Suspension and Termination

We may suspend or terminate your access if:

  • required by law or a third-party platform,

  • you breach these Terms,

  • your use creates security, legal, or reputational risk,

  • third-party permissions are revoked or blocked.

You may cancel your subscription according to your account settings. Cancellation stops future renewals; fees already paid are not refunded unless required by law.

Upon termination, your license ends and you must stop using the Service. We may delete or anonymize data consistent with our Privacy Policy, retention practices, and legal obligations.

16) Disclaimers

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE MAXIMUM EXTENT PERMITTED BY LAW, POSTYLAB DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that:

  • the Service will be uninterrupted, secure, or error-free,

  • third-party platform integrations will remain available,

  • scheduled posts will publish at a specific time or at all,

  • third-party platforms will accept, display, or distribute your content.

17) Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

  • POSTYLAB WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, LOST REVENUE, LOST DATA, OR BUSINESS INTERRUPTION, EVEN IF ADVISED OF THE POSSIBILITY.

  • POSTYLAB’S TOTAL LIABILITY FOR ANY CLAIM RELATED TO THE SERVICE WILL NOT EXCEED THE AMOUNT YOU PAID TO POSTYLAB FOR THE SERVICE IN THE SIX (6) MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM.

Some jurisdictions do not allow certain limitations; in those cases, liability is limited to the maximum extent permitted.

18) Indemnification

You agree to defend, indemnify, and hold harmless PostyLab and its affiliates, officers, directors, employees, and agents from and against claims, damages, liabilities, losses, and expenses (including reasonable legal fees) arising from:

  • your Customer Content,

  • your use of the Service,

  • your breach of these Terms,

  • your violation of any law or third-party platform rules,

  • your infringement of any third-party rights.

19) Export Controls and Sanctions

You may not use the Service if doing so would violate applicable export controls or sanctions laws, or if you are subject to restrictions that prohibit access to the Service. You represent that your use complies with such laws.

20) Governing Law and Jurisdiction

These Terms are governed by the laws of Colombia, without regard to conflict-of-law principles, except to the extent mandatory consumer protection laws apply.

You agree that any dispute arising from or relating to these Terms or the Service will be brought in the competent courts of Bogotá, Colombia, unless mandatory law requires otherwise.

21) Changes to These Terms

We may update these Terms from time to time. When we do, we will update the “Last Updated” date. Continued use after changes become effective means you accept the updated Terms.

22) Miscellaneous

  • Severability: If any provision is found unenforceable, the remaining provisions remain in effect.

  • Assignment: You may not assign these Terms without our prior written consent. We may assign our rights/obligations as part of a merger, acquisition, or asset sale.

  • No Waiver: Failure to enforce a provision is not a waiver of our right to enforce it later.

  • Force Majeure: We are not liable for delays/failures due to events beyond our reasonable control (e.g., outages, platform/API changes, natural disasters, war, strikes).
